I would say that calling the federal income tax "voluntary" would be too simplistic I've read the Internal Revenue Code pertaining to Subtitle A Income tax and the liability sections I can assure anyone that there is no code section that states that the income tax imposed under Subtitle A of Title 26 is Voluntary However, that is not the end of the story Most people assume that the federal income tax applies to them, without even looking at the Internal Revenue Code There is indeed a federal income tax It is in Title 26, Subtitle A br brHowever, who owes the federal income tax? The truth of the matter is that our Founding Fathers who created the US Constitution did not want the Federal Government to become Tyrannical like England Our Founding Fathers knew that the power to tax was the power to destroy Thus, our Founding Fathers created the Constitution in such a way that forbade the Federal Government from reaching out and directly taxing the property of American citizens They did this by requiring Direct taxes, which is what a tax on property or compensation is, to be apportioned among the several states per Article 1, section 2 of the US Constitution Because of the Direct taxing clause, Congress could not, and did not tax the income of Americans earning income within the 50 States So while the federal income tax is not voluntary, due to the Direct taxing clause, there is NO law in the Internal Revenue Code that requires Americans earning income within the 50 States to pay the federal income tax Simply put, the federal income tax is a foreign tax The federal income tax is imposed on Non-Resident Aliens earning income within the United States per 26 USC 871(a), and on Americans earning income OUTSIDE the United States br brFor a detailed report on what the Internal Revenue Code and the Federal Tax Regulations say as to what constitutes "Taxable Income," I would recommend reading this report called "Taxable Income Report" by Larken Rose This will show EXACTLY what the law says larkenrosecom/pdf/TaxableIncome2007pdf
