I don’t think this will get you banned as it’s the two 3DS’s communicating through Streetpass, that is a system different than Nintendo OnlinebrNintendo Game Servers shutdown for these and the shop shut down so now you can’t really get banned from the main functionally?

I made a whole bunch of fake game apps and would always launch one before going to StreetPass relays Stuff like "3D Championship Tiddlywinks" or my current profile pic, "Knuckle & Knuckles" And I did so responsibly by making their game ID and product code equal to a real, existing game, so taking it to the eShop would show you that real game instead
