What difference and or risk does a property owner as myself and my husband ,both non British non residence in the UK, should we consider in bequething our London home,which we use as a holiday / second home , in respect of inheritance in the UK? The laws in the UK are abusive and unreasonable, the children should inherit automatically everything that belonged to their parents if not stated otherwise by them!!! In the current situation I would just sell the property for a modic price, have a proper buy sell contract with a special clause that would state that I'm the only rightful user of that property until I die, basically just to make sure that they won't sell the property until I'm still using it!!! There’s a lot more too this to consider:br1 Asset preservation trusts have to be set up bearing in mind the CRAG report guidelines and supplementary additions as local authorities legal departments will challenge anything considered as deliberate deprecation of assets br2 There must be no evidence or documents relating to the avoidance of care costs in any part of the planning documents it has to be put in place for other reasons with the ancillary benefit of being exempt from long term care costsbr3 Medical records particularly GP and social services must not show any enquiries made regarding care or support or anything to indicate an anticipation of care within 12m prior to the trust being set upbr4 Remember for inheritance tax you lose the additional residential nil rate band if the property is in trust lowering for a married couple the allowance from 1million to 650kbr5 You need to fully understand the steps the trustees need to take after death along with costs for dealing with things after deathbrbrIt’s far simpler to sever any joint tenancy on the property and have wills made with a right to reside for survivor which protects at least half the house from care costs and retains IHT allowance fully and is at minimal cost Comment from : @Xcfhkrs |
