Thank you soooo much for your information! I can tell you one possible way someone can be $37K in arrears, and it has happened to me Few years after 2008 recession I converted my home loan into one giant HELOC as a last-ditch effort to try and make ends meet when everyone who was swinging a hammer for a living got chewed up and spit out in bloody pieces Got behind on property taxes; home went into pre-foreclosure, and in OR we have a state-funded mediation program in which the homeowner and creditor come to the table Mortgage company dragged their feet for more than 2 years, during which time they wouldn't accept payment on the loan Finally granted a loan-modification in which I received a 30 year fixed rate term and one of those coveted 28 rates I was grateful because during those two years we paid off all the prop tax arrears and became financially self-sufficient enough to afford the new fixed-rate loan Now that I'm paying the fixed rate loan, however, b******the mortgage servicer (let's go ahead and call them out; it's US BANK) electronic system continues to refer to the loan as if it is a variable-rate HELOC, despite dozens of written complaints from me*******/b so what I want you to know is that when you are looking at seller's mortgage statements, do not necessarily believe what you see!!! In my case, US BANK's automated system continues to send default notices to me despite the fact that I have paid on that loan religiously since Aug 2021 and am absolutely current on the contract Their monthly "statements" show an incorrect principal amount and demands for monthly installments vary from 31,000 to more than 80,000 I would like to take them to court, not sure exactly how, but in the meantime thinking of buying another property subject-to for my parents Thank you so much - blessings Comment from : @suzannebonham583 |

So do you always have to pay that 'accelerated payment' to get the loan current We often times see these numbers can be very high as well So I am trying to figure out how paying 40k more than what the house is worth just to get a better interest rate makes sense Or will the bank negotiate that payment to bring current? One thing that isn't covered here is if this is a good way to buy your forever home? If you're taking over payments for the original owner who gets the deed to the property if the house gets paid off? Can the original owner sue for the house again?
